Terms of Use – Fash

Welcome to Fash ("App," "Platform," "we," "our," or "us"). By accessing or using Fash, you ("user," "you," or "your") agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree, you may not access or use our services.

1. Eligibility

• You must be at least 13 years old (or the minimum age of digital consent in your country) to use Fash.

• By creating an account, you confirm that the information you provide is accurate and up to date.

• Fash reserves the right to refuse service to anyone for any reason at any time.

2. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.

• You are responsible for all activity that occurs under your account.

• You must notify us immediately of any unauthorized use of your account.

• Verified profiles may require additional documentation or identity checks. Fash reserves the right to revoke or deny verification at its sole discretion.

3. Fashion Posts & Content

• Users may upload images, videos, captions, and other fashion-related content ("User Content").

• By posting content, you grant Fash a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the platform.

• You retain ownership of your content.

• You represent that you own all rights to your content or have obtained the necessary permissions.

4. Prohibited Conduct

You agree not to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

• Post content that infringes any third party's intellectual property rights.

• Use the platform to spam, phish, or distribute malware.

• Attempt to access another user's account without permission.

• Use automated scripts or bots to access the platform.

• Post nudity, graphic violence, or content that sexualizes minors.

• Harass, bully, or intimidate other users.

5. Accolades & Creator Earnings

• Accolades are voluntary cash tips sent from fans to creators.

• Standard creators earn 70% of each Accolade. FASH VIP members earn 90%.

• Accolade payments are processed by Stripe and are subject to Stripe's terms of service.

• Fash is not responsible for payment disputes between users.

• Creator payouts are subject to a minimum threshold and Stripe's payout schedule.

6. FASH VIP Subscription

• FASH VIP is a paid subscription at $5.99/month that provides enhanced benefits including a VIP badge, 90% Accolade earnings, and priority support.

• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.

• Refunds for FASH VIP subscriptions are handled in accordance with the applicable app store (Apple App Store or Google Play) policies.

7. Intellectual Property

The Fash App, including its design, features, and branding, is owned by Fash and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

8. Privacy

Your use of Fash is also governed by our Privacy Policy, which is incorporated into these Terms.

9. Disclaimer of Warranties

Fash is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Fash shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Services.

11. Termination

• We may suspend or terminate your account at any time for violation of these Terms.

• You may delete your account at any time from Settings → Delete Account.

• Upon termination, your license to use the platform ends and we may remove your content from the platform.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Fash operates, without regard to conflict of law provisions.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via the app or email. Continued use of Fash after changes constitutes your acceptance of the updated Terms.
